    All,

    Sorry if I am posting on wrong thread. I am in the process of sending my documents for EAD renewal and had few questions

    Do we need to include a cover letter ?

    Also I am sending the following documents.

    1) copy I-485 receipt notice
    2) copy of EAD (front and back)
    3) two color photos
    4) Filing fee check $340
    5) Mailer stub received from previous EAD.

    Am I missing anything else?

    You are absolutely right, but that is not the sort of solution that Corporations see as what would raise american competitiveness. That is what this whole thing is about.


    I feel that even if the SKIL bill passes, there will be another bill in a couple of years to bring down the number of H1s. That is because, the American public will raise their voice.

    It all goes in cycles!

    There is no wrong doing by DOS by changing the VB, but the timing is wrong. They should have changed it as soon as they released it or else atleast by 25th or 26th to prevent some damage.

    As far as I can remember all I needed for SIN card was my landing papers and my passport as ID. I did not open a bank account in Canada so I can't help you with that one.

    Is there an advantage in opening a bank account if you plan to return to the US? Please let me know. I might want to open one myslef if it's going to help in anyway.

    hi all,

    Thanks a lot for all ur suggestions and support. As of now, nothing is moving on in my issue. The last correpondence with the employer was only when i sent mail asking for my money and got reply saying that they will contact their attorney to see what legal action they can take using non compete agreement. But till today, its calm and they are not replying to any of my mails or calls. I feel like its just a mail to scare me......took an appointment with attorney to discuss this and be geared up for action........

    Non-compete Agreements in New Jersey

    Should you sign that non-compete agreement?

    It has become fashionable for employers of all types and sizes to require their employees to sign non-compete agreements. These agreements range from very narrow to very broad in scope. A non-compete may bar you from working for a competitor, using or disclosing trade secrets or other confidential information, soliciting customers or recruiting the your employer’s customers. These restrictions generally last from a few months to a few years. Because signing such an agreement can severely restrict your future employment options, you (and your attorney) should review it closely before doing so.

    Can you be fired for refusing to sign that non-compete agreement?

    Yes, according to the Supreme Court of New Jersey. See Maw v. Advanced Clinical Communications, 179 N.J. 439 (2004).

    Will a New Jersey court enforce your non-compete agreement?

    Do not make the mistake of thinking that you can sign an agreement and ignore it later. New Jersey Courts routinely enforce non-compete agreements that are “reasonable” in scope. A non-compete agreement will generally be considered reasonable if it (1) protects the legitimate interests of the employer; (2) does not impose an undue hardship on the employee; and (3) is not injurious to the public.

    What will happen if you have signed a non-compete agreement that is not “reasonable”?

    If the geographic and temporal restrictions in your non-compete agreement exceed the boundaries necessary to protect your employer, a New Jersey court may modify the agreement by reducing those restrictions to make the agreement reasonable. See Solari Industries v. Malady, 55 N.J. 571 (1970).

    To allot a GC or Immigration is a leanthy process includes several steps so it takes time to pass through all these steps. After validating and checking all the documents the GC is alloted
    so the process takes time.

    Basis for this "trust", please?

    If USCIS continues to under perform, as they have been doing always till now (reason why EB3 ROW has moved substantially), then EB3 India will temporarily move forward this July.

    My gut feeling is that it may move to end of 2005, this is to enable DOS utilize as many VISA numbers as possible during the last quarter of the FY before the unused numbers goes down the drain.

    This is what Ron Gotcher also has specified.

    No one has to do a vote on scrapping CIR. The absence of any activity towards appointing a conference committee and scheduling a conference committee to reconcile differences between House immigration reform bill(HR 4437) and Senate immigration reform bill (S 2611) would cause both bills to stay as-is in house and senate respectively without making any progress towards becoming a law.

    No one has to formalize this. Not working on it is good enough to kill reform. I dont think anyone is going to come out and say "CIR is dead". However, if house and senate leadership indicate that "we need more time to read Senate's bill", or we need more time to understand and "Hold hearings" etc, its evident that they want to throw roadblocks and postpone it. Which is the same as pushing the bill to its grave.

    Excuse me for being a little blunt...but

    People really need to stand up and see what it takes to bring about change. People are loathe to drive 10 miles and attend a state chapter meeting, and you want to overhaul a system to the extent that you get credit for time/experience in US?

    I am not saying its a good or bad thing. What I am saying is, what you are asking for is a major overhaul. GC is driven by A PARTICULAR POSITION offered by A PARTICULAR EMPLOYER, where its proven that NO US CITIZEN WAS WILLING, QUALIFIED AND ABLE TO do the job. How can your previous job get you credit for such a position and petition driven GC process? If you want that, then system needs major change where GC is not drive by one particular job offer from one particular employer who sponsors you.

    So basically, you are looking for a RADICAL change in the system. Nothing wrong with dreaming, but kindly show some friggin activity and effort on your part before putting up new ideas on forums.

    Otherwise if you are sitting around and

    1. Offering new innovative ideas for GC reform on forum posts that lawmakers dont read.

    2. Never go to lawmaker meetings in DC or locally or attend any local meetups of IV.

    3. Cancel recurring contributions as soon as your EAD card shows up in your mailbox.

    Then please, keep your really creative and excellant ideas to yourself. Because Ted Kennedy is not going to change the system and give you credit for working here since 1999 or 1929 and reset your PD to 1999 or 1929 BASED ON YOUR BRILLIANT IDEAS on forum posts.

    you made two critical assumptions to support your claim:
    1) Since responses and postings of key members are sparse, they are working day and night on getting the immigration reforms through
    2) If key members post on these forums, they will necessarily post half baked news which causes excitement.

    Apparently you completely missed the point. I am asking core members to participate in discussion on these forums, not to put sensational headlines that excites people. Hope that helps.
    IV is making efforts to prepare for the coming coming months. It involves but not limited to funding drive to sustain and grow efforts, membership drive to grow in size and have impact of numbers, generating awareness and building support via media articles. Speculating will not help much. Pls. do participate in these drives in order to build momentum for the coming months and we will all have better chances for any legislative change. We are all in this together and we all need to work hard to enable a change

    Friends,
    Please give your opinion on my plan.

    Current Status:EB3 PD 08/2004, I140 Approved, Got EAD, Good relations with current employer

    I have no realistic hopes by getting GC by end of next year.

    New employment: Have an offer to start a new job around middle of next year by which 180 days will be complete. New job is very different than current one. Here is my plan:
    1. Don't file AC21, hope that I won't receive RFE since my PD wont be current for a long time.
    2. Change address, but give friend's address in the same city as mentioned on application
    3. Convince current employer to respond to RFE (in case any) positively
    4. May be have an arrangement with current employer to work part time when I start new job. So that way, I'll remain on previous employer's payroll and he can respond to RFE

    Does this sound far fetched?

    These guys are not consistent. I should have gotten a 2 year EAD.

    Dunno who to take this up with.

    Sorry to hear they gave you 1 yr EAD.

    I don't know why USCIS just don't make their ( and our) life simpler by just issuing 2yr EADs. Deciding how close to current is close enough for 1 yr EAD is extra effort. If its a funding issue, they can give the customer the option for multi-year EAD and extra fee.
