    All they can do is stop your salary and not re leave you from the duties. Also the day you put in your papers, they might cancel your H1B, which jeopardizes your status. So prepare for this. File the H1 B first get the approval then quit. These days it is very hard to get the H1b Transfer done.

    They can't do any thing else. All the best.

    Hello Sir/Madam,

    I badly need some advice with regards to a policy which i have in my current employment deputation letter for working in US.

    A brief info about me :

    1. I'm basically an employee of Wipro, India deputed in US on H1B.
    2. As part of this travel, there is a mandatory clause to accept certain policies of wipro ensuring that i do not move out of wipro in USA without giving a 2 months notice and also a liquidity damages of 4,20,000 INR equivalent to 10,000 $.

    My current issue :

    1. Its been about 2 yrs that i've been serving for Wipro in US and now in a state where i want to move out. I got a pretty good offer from another company that augurs well for my future.
    2. I Can give only 3 weeks of notice.

    Advice needed :

    1. Can i leave now with 3 weeks notice knowing that i had mandatorily signed the policy of wipro in india before coming over to USA.
    2. What are the legal implications of this? If wipro serves a notice do i need to reply to that knowing that as per H1B labor laws of USCIS, a company cannot force anybody to give a notice period of more than 2 weeks?

    Your suggestions will do a world of good to me. Thank you in advance.

    Being a consular processing 6 months is a goog time. If you are already working for your existing employer for more than 6 months, even on H1 then you can take a risk. Basically you need to prove an intent. No body expects anyone needs to be a slave to any employer.

    Did the police officers say anything against the deities or your culture? From your post, I assume no..if that's the case then you should understand the police officers are trained not to take their shoes off and take protective measures for themselves first when they are in these situations. In fact , even an internet cable guy won't take his/her shoes off when at work. As long as their purpose was not to harass you and they came with good intensions to help your family (in case something was really going on) you should take positives out of it that they acted quickly but only you can tell how they behaved and if your race or culture affected their behavior.

    Padmasree Warrior, executive vice president and chief technology officer, Motorola, and the driving force behind the company's recent growth and innovative successes, accepted the 2004 National Medal of Technology Award from President George W Bush on behalf of her company at a ceremony in the East Room of the White House on February 13.

    Warrior is also responsible for the success of Motorola Labs, the global software group and emerging early-stage businesses of the company. Her operational responsibilities include leading a global team of 4,600 technologists, prioritising technology programmes, creating value from intellectual property, guiding creative research from innovation through early-stage commercialisation, and influencing standards and roadmaps.

    She also serves as a technology advisor to the office of the chairman and to the board's technology and design steering committee.

    The prestigious National Medal of Technology annual award recognised Motorola for its outstanding contributions to America's technological innovation and competitiveness.

    Established in 1980 by an Act of US Congress, this is the highest honour awarded by the President to America's leading innovators.

    Ed Zander, Motorola chairman and chief executive officer, said, "All of us at Motorola are honoured to receive the National Medal of Technology from the President."

    "This award belongs not only to the talented employees of today but to the several generations of Motorolans who built our heritage of innovation. Given this heritage, we strongly support the President's plan to keep America the world's most competitive and innovative nation," he added.

    Warrior has been with Motorla since 1994 and is an alumnus of the Indian Institute of Technology, Delhi (from where she received her bachelor of science degree in chemical engineering). She then obtained her master of science degree in chemical engineering from Cornell University.

    "We applaud the Administration for proposing increased investments in R&D, in particular for the National Institute of Standards & Technology (NIST) at Commerce and the National Science Foundation," said Warrior.

    "From convergence to mobile Internet to nanotechnology, we must educate, excite and inspire our nation's children about science, technology, engineering and mathematics," she said.

    In an interview with rediff.com, immediately after accepting the award, Warrior said, "It's a great honour, I feel really humbled, and I feel very happy for all of our engineers worldwide, because the award is really theirs."

    She said being in the company of several other leading scientists and technologists who were also awarded the National Medical of Science and the National Medal of Technology Award, "who made these great breakthroughs in the fields of science and technology was very inspiring to me to be amongst of the company of these people."

    Warrior said while giving her the medal at the awards ceremony and also preceding the ceremony "he (President Bush) talked quite a lot to me and asked me if I was from India and I said, 'Yes, I came to the US on a student visa to go to graduate school and then stayed here.' And he said 'we need more people like you. We need more talented people from around the world to come and contribute and help our economy grow and build our innovative strengths to be competitive.'"

    She said Bush had also told her that he was looking forward to his visit to India. "He said, 'I am going to India in a couple of weeks and I'll be meeting once again with my good friend, Prime Minister Manmohan Singh.'"Bush in his remarks before presenting the National Medals of Science and Technology, declared, "It is a honour to be in the company of so many bright and distinguished Americans. Each of our honorees has been blessed with talent, and each has used their talent to the fullest."

    "The work we honour today has improved the lives of people everywhere. It has helped to move our economy forward and it has helped to make sure that America is the leader of innovation in our world. The medals are our nation's way of expressing gratitude to gifted and visionary citizens."

    Bush said that these annual awards "are the highest award a President can bestow for astounding achievement in science and technology. They recognise work that has helped expand the horizons of human knowledge. The National Medal of Science honors those whose research has enhanced our understanding of life and the world around us. And the National Medal of Technology recognises innovators whose work keeps America on the cutting edge with discoveries that change the way we live."

    I believe the only reason EB visa numbers have gone unused in recent years is due to the the inability of FBI in completing namecheck/background check in a timely FIFO fashion. As a result USCIS is unable to approve pending I485s even when the visa numbers are available. This also keeps the VISA BULLETIN doors closed for new I485s.

    This (besides labor backlog) spoils the FIFO for GCs.

    Fixing FBI security check process will end such visa bulletin fiasco. I believe in recent year or two USCIS has processed various applications (including I485) in a very timely fashion (ofcourse there are exceptions). But many I485s get stuck in the security check bottleneck. Since, visa number is assigned at the approval time the whole FIFO goes to hell.

    DOS should be issuing VISA BULLETIN based on pending approvable I485 (meaning security check complete) and fiscal year visa availability. If former is smaller than latter then bulletin dates should move forward based on approved I140s which have not applied for AOS. This is not rocket science but simple math which is lost on DOS, USCIS & FBI.

    However, fixing FBI security checks (timely completion) will restore FIFO once labor backlog is gone.

    FBI delays is the prime reason for this fiasco.

    BTW my AOS is pending due to indefinite background check delay.
    Every guy thinks that his/her problem is always the biggest bottleneck

    Not sure how its good news, it is good for USCIS as they will get money for pre-registration while we do not get the EAD till the priority date becomes current.

    It will not compel them to make dates current when they need money by allowing folks to file 485



    Sakthisagar & RSM144 many thanks for posting, the spring document has a target date of Oct 2010, I believe there is a chance of this happening sometime with the fee increase, they will have a fee for this. Hope this rule comes into play it is good news for us.

    Another follow-up question.. I'm planning to file for EAD, which passport number should I use in this form ?
    If I use new one(which is valid), isn't it in contra with AOS application?

    Has anyone faced this situation ?

    I would like to know the answer to this question too. does anybody know?

    also pkv..how many days did it take you to get the new passport?

    I work for Company A, applied i-485 and both got EAD & AP.She is the dependent.
    My Wife works for Company B which sponsored her H1.

    So, I guess she cannot continue to work on H1(company B) upon returning using AP(got as my dependent thru Company A) !!!?? am I correct?

    As per my laywer, you should be able to work for an H1B and still re-enter using an AP. However for questions like these it is best to consult a GOOD attorney.

    Anybody else in the same boat?

    I'd say proceed with filing 485 for now and later you can think about porting etc.
    Rather try filing it yourself and save lawyer fees ($1500 per primary applicant and $2000 for primary + dependent? geez this is a special offer?)

    according to your info, can i assume:

    out of 360K,
    270k belongs to EB3
    135k still in DBEC (lets say 100K for 2001-02 cases)
    135k still in PBEC (lets say 35K pending 2001-02)
    so still 135k pending for EB3 for 2001-02.
    so what is ratio of big 4 vs. the rest in EB3? any guess?
    no one knows monthly BEC approval rate either right?

    i am trying to guess how further will it retrogress...(well no one knows but...)

    EB1 is typically for Phds with solid publications behind their belts.

    In some cases the individual can sponsor himself without an employer as such people are considered a good value add to the US. In other cases, an employer has to have a bonafide job opening requiring such skills (mostly professors, research, etc.,). These people are usually given their Green cards in ceremonies unlike EB2/EB3 where the card is mailed out in a USPS envelope.

    There is also an easy way. In some companies in India, people with 5-6 years of experience are promoted to Project manager roles and have a group of people reporting to them. If this company transfers them to the US to continue the same role, they become eligible for EB1. So in a typical case,

    complete education at age 22 and join company x as a software engineer
    get promoted to Project manager at age 27 (5 years later)
    come to the US at age 28 ( a year later)
    apply for GC on EB1 (directly apply for 140/485 as there is no Labor required and also PDs are current)
    get GC at age 29

    you are all set...get married, buy the mini-van (Odyssey or Sienna), perhaps open a India/Pakistan grocery store on the side which rents out pirated DVDs of desi movies and enjoy life!

    I know you are being pointedly sarcastic at a section of green card applicants but Project Managers are not eligible for EB1. (Don't give that section any bright ideas) Only multi-national executives (VP and above are)
    in addition to researchers who have exceptional track-record (no, publishing papers in IEEE digest doesn't count)

    Haven't heard of EB1s getting GC in ceremonies. After all the little piece of plastic is not an award of merit or anything (even though lot of us seem to think so :D)
